Amazon Starts Trademark War

After officially announcing their move to Australia in early 2017, online retailing giant, Amazon, has taken on a small Perth-based retailer in a battle over the Australian trademark for ‘GLAMAZON’.

 

As one of the world’s largest online retailers, it’s not a surprise that Amazon has an extensive Australian trademark portfolio; consisting of registered Australian trademarks for ‘AMAZON.COM.AU’, ‘AMAZON PRIME’, ‘AMAZON FRESH’, and many more. Now, Amazon has launched opposition proceedings against small Perth-based retailer, Live Clothing, in response to their attempts to trademark the terms ‘GLAMAZON’ and ‘GLAMAZON THE LABEL’.

 

Live Clothing already owns registered Australian marks for ‘GLAMAZON’ and ‘GLAMAZON THE LABEL’ in respect of clothing, footwear and headgear. Earlier this year, Live Clothing filed further applications to trademark both terms in relation to various retailing and wholesaling services, which Amazon swiftly filed oppositions against. Amazon is the owner of a registered Australian trademark for ‘GLAMAZON fashionweek’ and ‘GLAMAZON’ is reportedly the name of an internal Amazon social group for LGBTIQ employees.

 

Amazon is due to submit their evidence in support of their opposition claims against Live Clothing’s trademark applications later this year. As Amazon prepares to settle down in Australia, this case may just be the first of many more to come as Amazon clears the intellectual property pathway for their future business ventures.
